    Hall case shows more system flaws



    "SO this is the mess the AFL tribunal system has led us to.

    On grand final eve, no-one can say with any sureness how Barry Hall will be treated by the match review panel.

    This is despite a pre-season competition, 22 rounds of premiership football and three weeks of finals.

    This is despite a set-penalty system that was supposed to bring surety and transparency to the league's judicial process."



    "If Gehrig's suspension is to be a guide, then Hall will not play in the grand final. If Didak's elbow to the chest of Darryl Wakelin was worth a two-match ban, then Hall won't be tying up his bootlaces for a slab of matches. If Goddard's adjudication is a precedent - and it is all but identical to Hall's offence - then the Sydney skipper will line up at the MCG on Saturday.

    Similarly, if Koschitzke's contact did not constitute a strike, then Hall can well argue neither did his. In both cases, the players struck fell to the ground. If the impact of Goddard's blow was considered low, then Schwab's panel can hardly assess Hall's blow any more harshly.

    Such has been the inconsistencies of the decision-making by the match review panel and the tribunal that it is impossible to predict Hall's future. That is the very opposite of what Anderson told us his system would ensure - surety, transparency. "

    I thought the gehrig decision was a joke but the Didak one was pretty fair IMO. I have faith that the swans will be fully prepared to fight a suspension though. There is more than enough precedence for this type of incident for them to use. I'm feeling more confident about it the longer it goes on.

      They have called for medical evidence apparently. That could be the decider. If Maguire was sick before it could help Baz, if Maguire was injured by Baz it'll go the other way.

      3pm!!!!! I'm not sure I'll last that long.

            Have they ever asked for it before in a stomach punch incident? Seems pretty strange.

              It seems strange if they are trying to find out how hard he was hit. But it makes more sense if they know the Swans are going to argue that Maguire was already ill, as the video seems to suggest.

              Legally, it has an impact on intent - as our recent Bouncer v Hughes case showed (and others when the victom has a thin skull or the like).

                          Spoke with a Doc today about the incident which he has viewed a zillion times like the rest of us and he considers the time between the alleged blow and Maguire's reaction of pain was too long.

                          He believes that the delay is enough to suggest that he was staging to some degree.

                          This incident is going to be analysed a zillion times, it really irks me that we're even talking about it. What a bloody shame!

                            yeah i heard that as well this morning on the radio but i havent seen the incident since then.

                            maybe we get dr peter larkins on it, he has a good reputation within AFL circles
