Whether it's 'in play' or 'behind play' is a tactical decision that the Swans have to decide whether to run, b/c it is only by pleading guilty but also pleading that it was 'in play' that we can get the 25% discount from 125 points and BBBH can walk. Presuming that the Tribunal does offer 25% discount where you admit the charge but dispute the grading. The Swans' website certainly seems to indicate that it does.
If the Swans run this line, then there will be no need for Maguire to give evidence at all, as the offence will be admitted.
So if Sydney (perhaps foolishly) try the 'death or glory' tactical approach, and BBBH disputes being guilty at all, then it's true-- only Maguire and The Code can save him. The absence of any umpires who saw the incident, and the lack of footage of BBBH's fist/hand actually meeting Maguire's tummy would mean that it would be unsafe for the Tribunal to convict without inculpatory evidence from the 'victim'.
