    I can understand if it was deemed as intentional, but intentional contact when he missed.

      It looked unintentional to me, even with both of my eyes open.

                Welcome to the beauty of mandatory sentencing. Everyone thinks, 'Let's set up these fixed categories so that every case gets dealt with the same way: that looks about right', and then is forced to apply them to cases where they are laughably inapplicable.
