Good luck to him. The other side of the coin (so to speak) is the case of Stan Laurel, who discovered he didn't have any rights to the image of his own face. Mind you, it's getting hard to tell the difference between AFL and Hollywood...He reminds him of the guys, close-set, slow, and never rattled, who were play-makers on the team. As a close reading of the article makes clear, this is not:- a test case
- a case arguing that Leo is entitled to special protections not afforded to anyone else, or
- a case that sportspeople 'own' the rights to photographs taken of them in action.
There is a collective bargaining agreement. It is a contract between all players and the AFL. It requires certain permissions to be obtained and money to be paid when an AFL player's image is used for certain commercial purposes. It is alleged (and seems to be the case) that in the case of this image as it was used for an advertising purpose, that wasn't done. Nothing at all to do with whether newspapers, magazines, and kids sticking posters up on their wall, need to pay a tithe to the footy players depicted in those photos. They don't.
The fact that betting is (in some people's minds) closely associated with footy, is neither here nor there. Tabcorp produced an advertisement with the intention of increasing their revenue and profit, like any other business. The issue would be the same if the ad was for crumpets, springboards, or the WA Tourist Commission. ('Leaping Leo says, Jump over to Perth!')
Is Leo putting himself before the team by taking this action? In the mind of a dodgy employer, he sure is. Anyone who doesn't let themselves get walked over by an employer who doesn't keep their end of the bargain, and actually demands their rights, will get accused of not being a 'team player'.Comment

One of Paul's first addresses to the players after he became head coach was to acknowledge them as individuals: 'You know that old football adage about how when you come to a club we will treat everyone equally?' he said, 'Well, that won't be the case here because you are all different'.
On other occasions he's been quoted in the press as having said that 'football now is about coaching individuals in a team environment', though I'm not sure it's widely recognised just how different that approach is to the NO-'I'-IN-'TEAM' coaching philosophies of the past.
Even though the stuff in this book specifically about the Swans is short - just a few pages - it's a very interesting read, and through Ray's tales of the various organisations he's worked with and their varied approaches to adopting his philosophies, it's possible to get a much better sense of what the "Bloods' culture" is really all about. than you'll ever get from odd references in fluffy newspaper articles.Comment

I think it's pretty straightforward case here...
For mind, you only need to ask two questions:
1. If you were to ask the general public/fans/supporters/players/etc what the picture is of???, they would undoubtedley respond with - Leo Barry Taking a screamer to save the 2005 grand final. Therefore, he is the subject of the picture.
2. Has the AFL OR Tabcorp made any money from the picture???
Having established it's a picture of Leaping Leo Barry, and that someone's making money off it, why shouldn't Leo get a piece of the pie???Comment
