Somehow I don't think so. The bottom line is that he and his wife had an investment company and many friends and colleagues trusted them as a business to invest large amounts of money for them.
The charge is fraud because he has allegedly taken that money and gambled it away. Its a huge deal. Huge. The losses involved are big, really big, not only financially but personally. If found guilty its not a case of "fess up and do your penance". The charge is a full on crime.
