            You mean surely he has a case. He gave no permission for its use, nor did the AFLPA. I assume this means the AFL used the picture as if it was simply an 'action shot' with a group of AFL players, hence the property of the AFL.

            It is a simple fact that the person that photo is all about is Leo Barry (you star!!). And it is recognisable for that fact. And that in 20 or 50 years time, it will be Leo Barry that people will recognise from that photo, and struggle with the others.

            Using the image of any one player in a promo entitles them to royalties. Leo deserves them in this case the same as any other player they use in a 'stand alone' promotion.

              I suspect the choice of photo means his case isn't that strong. Had they used the picture of him at the top of his jump, taking the grab, it would clearly be a picture of Leo. But that shot is really just a group of players competing and, if you didn't know the circumstances, you wouldn't pick it as a picture of Leo over and above any of the other players shown.

                Yep. It's a photo of half a dozen or more players and mentions nor refers to any of them.

                  The choice of photo shows Leo Barry and other players in a marking contest that is clearly similar to other photos of that marking contest in which Leo has marked the ball. The intent is clearly to promote that mark. Ask 100 random people familiar with the AFL and the majority will be able to identify when and where that photo was taken, and who marked the ball.

                  If Leo is successful with his case I feel he should share the proceeds with the others in that photo. Without the others in that marking contest, it would have been another unremarkable defensive mark.

                        Obviously somebody is after his/her percentage. The problem is that Leo looks greedy not the manager.

                          Does the AFL have rights to the photos I took at the game? Or at any game? It's a load of bollocks.

                              10/6/06 = loser.

                              Was it Roy Cazaly who took a one hander in 1933 and we didn't win a flag for another 72 years.

                              Leo as they said on the tele is I think top 3 for frees against. Wonder how many goals have resulted. Probably having a decent affect on our %.
