The point is he could be, as it is probably a breach of contract, express or implied, unless he has an express term in his contract permitting mid season negotiations.

Where is the slander? Its true and the imputation is accurate. I'm confident any jury would find a player who shopped his wares to an opposition club just before a critical match was both cynical and uncommitted to the club.

A basic right to talk and negotiate with an alternate employer. An express contractual obligation not to enter into employment negotiations with a potential employer may be enforceable (but may not - it may be considered an unlawful provision). I am led to believe that there is no such implied right in an employment contract.
