I knew him as a gentle young man, I cannot say for sure the reasons for his decline

I wonder about where i studied as well. Haven't got time to give you all the precedents but these will have to do. The implication of the term in Australian employment contracts survived the Howard attacks.
Soory, did not realise that you were just trolling.
My favourite bit of all this is your balls up of the poke at Howard. According to your argument an employee does not have a right to negotiate with a potential employer because of an implied obligation not to, and this was an element that survived Howard's workplace policies. Surely this, if such a thing existed, would be in the employer's favour? Why then did it need to survive Howard's policies?
How is Davis missing training on Friday different to Hall going to Fiji?

Yep, was thinking the same thing. And Hall went straight to the papers after being told he was dropped after the swing at Wakelin and missed the Sunday rehab session and first training session in the week as well.
There's no doubt Davis has some issues but Roos has got to take some of the blame with his poor handling of him as well.

Gold - from the tribunal's deliberations on the obligations of the employer:
the need to ensure that the skills and qualifications possessed by a displaced person are utilised either in the employing department or public sector generally where such skills and qualifications are required or are in short supply.
Wonder if the Swans could indentify any part of their organisation where Davis' skills are "required or in short supply"?
Do you think that maybe the club knew where Hall was?
For someone that does a lot of intellectual chest thumping, that's a pretty dim observation.
Maybe they did, maybe they didn't. Maybe some people in the club knew Davis wasn't going to training, maybe they didn't.
Seems strange that Hall is given time off away from rehab but Davis isn't. Similarly it seems strange that Hall can comment to the media and have a whinge, but Davis can't. Obviously we don't know all the details of what is happening behind the scenes, but from what we see as outsiders there are some strange goings on.

Particuarly when one is expected to play again that season and the other's season is over.

My interpretation only:
Hall was told to get away from all the media hoohaa, get some rest and get your head right. The main point being the media frenzy.
They seem to have done the same thing with his recent indiscretion.
Davis has been told he needs to work harder on certain areas. I'm sure this would include training sessions.
Having said that though, isn't Davis out injured for the rest of the season? Then why would he need to train??
Certainly possible, but it's still all rather strange.

Sydney coach Paul Roos seemed amazed that Davis did not turn up to training on Friday, only days after saying he was keen to play for West Coast next year.
"No, he wasn't at training on Friday, so the reformed Nick Davis couldn't turn up to training, so I am not sure why,'' Roos said.
"I don't have a chance to chat to him because he didn't turn up. So hopefully he turns up tomorrow.''
Roos later told Triple M Davis might have been confused about whether he was in the club's rehab group, but was clearly unimpressed.
Not a lot of ambiguity in there. The club(Roos at least) had an expectation he'd be there, and he wasn't.
Pointing the finger at Hall might have been a defence if they were primary school kids. What ever Hall did or didn't do after his incident was condoned by the club. If anything was outside of their expectations, they weren't to the extent that it was worthy of discussion in the media.
Davis only has himself to blame for the fact that his name is going through the mud. Had he not made comments about West Coast, Roos would not have speculated about his lack of attendance at rehab.

Because the knee is not that bad,he will never wear red and white again. It is a cover up.

Davo had a WHOLE PAGE of whinging in yesterday's Sydney Sun-Herald.
Wild speculation, unsubstantiated rumours, silly jokes and opposition delight in another's failures is what makes an internet forum fun. Blessedare the cracked for they are the ones who let in the light.
As much as it saddens me, one thing is for sure. If he wasn't already gone, he certainly is now. He'll never play for Sydney again.
I'll always remember the PF in 2005 as one of the greatest games of football I've ever witnessed. His last quarter was probably the most impressive and most important individual performance by a Swans player in the history of the club and probably, one of the best ever in the history of the entire AFL.
